This agreement is made for the benefit and protection of both the Buyer and the Seller.  Seller guarantees this puppy to be free of hereditary and genetic defects for the first 26 months of age.  Should the puppy develop a scientifically proven genetic disease that is confirmed by two licensed veterinarians during this time, the Breeder shall replace the puppy with a puppy of the same value (or the difference can be paid by the buyer). If the poodle has been bred before the defects have been found, this guarantee is null and void.

The Breeder warrants that the puppy is in good health and free from communicable and non-communicable diseases at the time the Buyer takes delivery. The Breeder shall provide the Buyer with the puppy’s inoculation record upon delivery. The Breeder offers a 72 hour well-puppy health guarantee. This means that the Buyer must take the puppy to a licensed veterinarian for a well-puppy check-up within 72 hours of possession. If the veterinarian diagnoses the puppy with any untreatable illnesses, a replacement puppy of same value (or Buyer can pay difference) will be given with the return of the first puppy (at Buyers expense). All papers shall be returned as well as proper signatures for transfer. No veterinary or shipping costs will be reimbursed by the Breeder. This agreement is made and entered into in the State of Texas and shall be informed and interpreted under the laws of the State.

 

The puppies sire and dam are both certified as free, at the time of breeding, of hip dysplasia and all testable diseases for their breed. We have done our best to ensure that your puppy will be free of hereditary disease.  

 

The Buyer agrees to provide this puppy with proper vet care, diet, housing, socialization, and grooming for his/her entire life. The puppy should be groomed approximately once a month or more often if necessary.  The Buyer agrees that if at ANY time in this puppies life, the Buyer is unable to keep him/her, that the puppy is returned to the Seller or lets Seller know first that they are unable to keep it.  Under NO CIRCUMSTANCES shall this puppy be placed into a shelter, a pet store, placed with a rescue organization or foster care.  The Seller will take the puppy back or help find him/her a new home at any time during its life.

 

The Breeder agrees to be available for help throughout the entire life of the dog. The Breeder maintains a continuing interest and pride in this dog and in its accomplishments. Any phone calls, letters, photographs, updates, etc will be much appreciated.

 

The Buyer agrees NEVER to use this puppy for breeding of any kind. This agreement extends over the entire life of the dog. Should the Buyer use, or allow the poodle to be used, for breeding, legal remedy will be sought.  The Buyer will pay the Breeder $10,000 plus any and all expenses, including but not limited to attorney fees, as compensation for damage to the Breeders reputation. The Buyer will also forfeit ownership and will ship, at the Buyers expense, the puppy to the Breeder. This agreement is made and entered into in the State of Texas and shall be informed and interpreted under the laws of the State.

 

The AKC and/or UKC registered name will contain the breeders kennel name "WeKay".

Limited Registration Contract (AKC Limited Registration) 
This poodle is sold as a companion.  It is NOT to be used for breeding (intentionally or unintentionally).  The Buyer agrees to have the poodle spayed/neutered before it reaches 18 months of age.  The Breeder will retain all AKC registration paperwork until proof of spay/neuter has been provided.  If the buyer wishes to use said dog in performance events and needs AKC/UKC papers to earn titles, the said dog will be co-owned between Buyer and Seller until proof of spay/neuter is given.  At that time, all papers will be signed over to the Buyer.

 

THE BUYER AND SELLER HAVE THOROUGHLY READ AND UNDERSTAND AND AGREE TO ABIDE BY THIS CONTRACT.
